Riddle me this:

How does a man that goes crazy in a theater causing mass killing not end up with holes in him from the police that respond? Did this guy suddenly lay on the floor and surrender when his weapon jammed or what?

Once he surrenders and no longer is causing an imminent threat, deadly force is no longer authorized. Though I must say, kudos to the responding officers for acting how they were trained and not blowing him away regardless!...no one would have blamed them otherwise...

Agreed. If he was not an imminent threat at the time LEO's encountered him they have no legal justification to shoot him. As much as we want to shoot there are legal guidlines that must be followed.

If not, then LEO's become nothing more than execution machines of the state and we see that in Syria, Egypt, China etc. Rest assured neither you nor I want to see LEO's go rouge aka vigilante here. Once we start down that slippery slope there is no stopping the normal degeration into complete anarchy.

I would also suspect at that particular tme the officers had no clue as to how many was killed or injured either. Might have been a whole different ending for this guy then but I would say MLESA is right, ...

Had I been the arresting officer I would have sworn that he was going for another gun. Oops, my bad.

muggsy with the plethora of security camers in the public today that is a very BAD idea that could have very serious negative future repurcussions. Back in the day that would probably have worked. Today it is foolish to even think of trying it. You never ever know where all the cameras are.

By dressing up as, and attempting to impersonate, a SWAT member.
I'm reading reports that this may have indeed been the case.

Initial police accounts said Holmes surrendered without incident to police
who found him at his car behind the theater complex.
But Oates, in an interview on CBS Face the Nation Sunday described a more complicated scene in the minutes after the shooting.
He said officers arriving at the scene might have mistaken Holmes for a SWAT officer.
He was allegedly dressed in black ballistac gear, including a helmet, throat guard, vest leggings and gloves.
Oates said a piece of equipment in Holmes elaborate gear - he would not specify which - struck one of the responding officers as irregular.
The officer questioned Holmes.
Oates did not describe the exchange, only the result: Holmes was arrested.

good points in this thread. Media is saying trial could take year(s).

Side note. Just found out buddy was mugged. Bat to the forehead. 18 sutures to close. He doesnt remember a thing just before or during the attack. He said he is still foggy. Man this world is getting worse and worse.

I heard on the news that when the dude was outside dressed in his duds, initially the cops thought he was a SWAT guy.

And Muggsy that is why Longitude Zero is the LEO and not you. Longitude Zero is correct. They did not have any justification to shoot him because he did not give them any reason and show any threat at the time.

Jlottmc and I were talking after all this happened and were wondering WHERE were all the CHL holders in all this. There had to be a few people that had CHL's.

well it was a gun free zone so most people with a permit would not carry there. Also just because they have a permit doesnt mean they high percentage carry nor have had or continue to train with their carry gun. In short, they might be running too.
