I was just talking with my secretary about all the anti-gun stuff that's going on around the country right now; and the following question came up ... if the proper process was used to repeal the Second Amendment, what would our reaction be?

If the anti-gun people got two-thirds of the state legislatures around the country to vote to repeal the 2nd Amendment ... and then got two-thirds of the U.S. Congress to vote to repeal ... would we then turn in our guns if required to do so?

If we believe in the Constitution, and in due process ... then we should willingly submit to the result if due process is followed.

Tough question, assuming you are not assuming that it would result in an all out Civil War II. But assuming it happened w/o a major uprising, then I think many would hide stuff and many would turn them in. In the end, there'd be more folks doing the former than the latter and I think and nothing would really change as far as quantity of firearms in private hands. It'd just be under the table at that point. I'll just refer you to Prohibition. If they then started going door to door, all bets are off, I'm not really sure what I think would happen in those cases. I don't think it would be pleasant.

As to the due process debate. You can make a case on both sides (legally), depending on whether you believe in the pre-Lincoln USA or the post-Lincoln USA. I believe in the pre-Lincoln version (and no, I don't think we should own slaves again or start openly advocating racism). The one conceived and setup by Jefferson, Madison, Hamilton, etc. Not the one bastardized by Lincoln, Wilson, Roosevelt, Johnson, and now Obama. Just picking some key folks, there is PLENTY of blame to go around. And I'm not letting Congress and SCOTUS off either, same criticism.

For what it's worth, the supreme court ruled in the late 1800s that the bill of rights did not grant those rights..rather, it simply put into words that the federal government could not infringe upon those rights.

Therefore, as the right to bear arms is inherent, not granted by the 2nd amendment, repealing that amendment would do nothing.

They also ruled later that the 14th amendment clarified that protection from infringement applied not only to the federal government, but also to the states (hence the recent 7th circuit decision stating that lack of concealed carry in Illinois is unconstitutional).

So basically, they can repeal it if they want... but it won't take away our right to bear arms.

Rights are not granted by government. Thus, they can't be repealed. Privileges are granted, and keeping and bearing arms isn't a privilege.

But the Supreme Court has also ruled that your choice of weapon can be limited. So they've spoken out of both sides of their mouth. They can infringe or they cannot. Can't have it both ways. In the end, if Congress and the states repealed it, the SCOTUS would have a tough scenario on their hands. It's been repealed by the rules of the Constitution, they would in theory have to uphold that due to the nature of their job as defined in the Constitution...but they would be ruling that way in the face of prior decisions that indicate this is a 'natural right' outside of the Constitution.

The Constitution is the law of the land, not the Declaration of Independence, the Federalist Papers, or original intent. That situation I find causes me many sleepless nights and grief. It's a pisser...

If they'd just stuck to the document to begin with...but nooooooooo...

We're just about screwed by the composition of the SCOTUS now. We HAD 4.5 conservatives, but with Roberts' take on the Obamacare ruling, one more liberal appointee by Obama will push us into 5.5 to 3.5... or 5-4 in favor of the Left and blowing off the US Constitution completely.

I don't see any favorable rulings coming from the SCOTUS with ONE more Liberal there.

It's not like we have an impartial Attorney General, either!

Spoken by someone with a head on his shoulders. The first ten amendments to the constitution simply enumerate our inalienable rights. Inalienable means that they can't be taken away. They are our God given rights.

MRAPs and others, buying hundreds of thousands of coffins, and something like a 7,000% increase in MRE-type meals. Whose security are THEY interested in?? I didn't mention the FEMA camps. I'm not a conspiracy theorist, but sh!# is happening. They are preparing for something... and DOMESTIC terrorists are top on their lists of "threats", especially those G.I.'s returning from overseas with combat experience!

Wifey just said that I ought to be her secretary... she thinks I can type better than she. I might be slightly more skilled at typing than Jocko... maybe. I do try to check my spelling... over... and over.... My timing is terrible and I know when I'm making a mistake... and I have to back up and correct too much.

My typing hasn't improved since my enlisted time in the USAF where I had to pass a 20 WPM typing test... just keep taking it until you got 20 WPM!

My first wife tested at about 125 WPM when I was in college!
