After a review of the play the ruling on the field will be over turned. It was obvious to me that his girl friend was attempting to assault him on the elevator and he was simply defending himself. It was a single righteous shot to the head with his left. Evidently she knew that she was in the wrong, because she didn't press charges and married the S.O.B. anyway. Either that or she's looking for a big cash settlement when they divorce. He certainly ain't no choirboy. Who really gives a damn? :)

What good does it do to deny a man his livelihood for a moments indiscretion. In a month he'll be on welfare and you'll be supporting his behind. If he falls further from grace he may end up in prison and that will really cost us. Who among us hasn't lost his or her temper momentarily. He didn't knock out the lady down the street. We have no information as to what led up to the altercation. There was no sound on the video to hear what was said. We're judging his actions on a video tape alone. Were there any previous examples of abuse? I'm not one to rush to judgement. As I have past dealings with domestic violence victims, this may not, I repeat MAY NOT have been the first time something like this occurred with him. I once had a victim whose boyfriend broke her arm after beating the **** out of her. She was asked why she continued to stay with the dirtbag. Her response was "because he loves me." And this was not the first time I had dealt with this victim/abuser. Bottom line is this is WRONG on so many levels. Seems our society loves to put these guys on a pedestal, and that they can do no wrong. And we all know that if this was Joe Citizen, he would be under a jail somewhere.

A bit more info on my previous post. I once had the same victims father call me after said dirtbag beat his girlfriend. He BEGGED me to talk to his daughter to try to get her to come home and get away from him. I told him I would try, which I did do. Also, the County Detective who assisted tried to talk some sense into her, to no avail. She then stood in front of the judge and told him she refused to testify against him!!! Even after he broke her arm....So guess what, charges were dismissed!! No victim, no crime!!! I don't understand how you consider a man kicking your ass everyday as LOVE!!!

And there in lies part of the problem. A victim can come into a court room beat to hell and back, arm in a cast, face swollen, etc, and tell a judge I'm not going to testify against my attacker. The court system has no choice but to dismiss the charges. Our laws need to change in that photos of the injuries, the police/hospital reports, witness statements, etc, can be enough to proceed in charges these clowns. You may not hear too much of it, but it happens ALOT!!! If victim refuses to testify, charges go bye bye..

agree wholeheartedly... something should change, just doesn't seem right especially when you have eye witness' available.. If the law was written different I'm sure there would be a lot of people alive today to thank them for the change....
You rob someones house and even though they 'choose' not to press charges, the DA and the state charge you regardless..
Either way you stack it, do the crime you 'should' do the time...
knkali
09-10-2014, 10:31 AM
NO. That line of reasoning opens the door to a complete police state. You have the right to determine if you have been wronged. If I do not want to press charges then I am saying to the court that no crime against me has been committed. This is self governing at is most basic level.
swilcher7
09-10-2014, 12:31 PM
How is that leading to a police state? Our domestic violence law clearly states if certain crimes have been committed (ie: assault) and you see visible injuries on said victim you MUST make an arrest. That's black letter law. But in the same sense the victim can come to court with evidence of injuries still present, say I don't want to testify, and the case will he dismissed, and they are a happy couple again. But if the next time the abuser beats and kills victim, then it's law enforcements/ courts fault that he was let go..... That's what's wrong here. If you have to arrest said abuser? Than he should do the time for his crime..,
knkali
09-10-2014, 12:41 PM
when the authorities determine if a crime has been committed against a victim even when the victim says it has not then you have slipped further into a police state. The State has then been given all the power and control---you are now a subject not a citizen. What's next, a knock on your door and you are arrested for a crime you did not commit but the authorities say you did? See how this can become a slippery slope. When we try to "fix" everything for everybody all the time, it comes at a price. Be careful what you wish for. You might get it.
Domestic violence is horrible. There are a myriad of reasons why people continue to subject themselves to it over and over. I cannot fix that nor will I give up my liberty of determining if I have been wronged or not and give up that determination to a third party to decide. If I have been wronged, I speak for myself. Of course this conversation is only pertaining to adults.

All the times the wife beat me down, the mental and verbal abuse, I don't know why I just stay and take it.
I feel like a door mat.
What makes me happy is around here quite often its the violet that gets arrested. Never used to happen.
We have frequent fliers, cops know them well, wife hits husband and then calls saying he hit her but the evidence never seems to stack up and off she goes. I give a big hurrah when I see those.

I disagree. Had a local case here where female called 911 on cell phone while being abused residence. Police show up and abuser refuses to let them in and says everything is ok. They made no attempt to contact caller. They leave and a few days later she is found dead in residence.. That was a failure on many levels!! I for one an not paranoid with the police doing their jobs.. Some of our laws need major revision. I'm don't want to go off topic here. This is about finest I violence not us becoming a police state.

Criminal cases are not the same as private lawsuits. Crimes are prosecuted not directly because of the victim, but to protect everybody. If the victim wants to prosecute but the authorities decide not to for any of a host of reasons, the case is not prosecuted. You can sue for damages in civil court, but you cannot hire your own prosecutor to bring the case in criminal court and put the defendant in jeopardy of criminal punishment such as prison. Conversely if the victim doesn't want to go forward but the authorities decide the case should be pursued anyway, that's what does (and should) happen. Its always been that way in this country.
As a practical matter, the victim is usually cooperative and the prosecutor might not be able to proceed without her willing testimony. In domestic violence cases that is frequently not the case for many reasons including love and intimidation, but its important to go after those cases anyway when possible. They are very dangerous for everybody, especially the police, and the authorities should not just let it go just because the victim says she prefers that.

Not everywhere. Here in OK the Domestic Abuse Statutes take the victim completely out of the picture. If the responding officer can detect an injury "no matter how slight" the suspect "must" be arrested. We get dang near all persons so arrested are convicted based upon the officers testimony and photographs alone. No victims is needed or wanted to prosecute the case.

Good!!! I wish it was like that here. I know each state has different laws. Most of the cases, no the majority of the cases were the same people all the time. Even though you pretty much knew what the outcome is gonna be, you still have a job to do. That's where I think some people talk out both sides of mouth. Certain situations they want police to do job and support them, while other times the don't want them too and are against them...

swilcher7 sadly there is a great amount of repeat business here. We call them Frequent Flyers or Old Friends. Unless the cycle is broken ALL domestic violence eventually leads to homicide of one of the parties by the other.
Bawanna
09-10-2014, 01:19 PM
The sad part is the victim frequently is so financially dependent for themselves and any children that they don't feel they have a choice to leave. They take the beating for the money and usually only a limited amount at that. Food and shelter at the cost of being a punching bag.
Here we're much like LZ mentioned. If there's obvious signs of injuries an arrest is mandatory. After that basically the officer can be the complainant and can possibly go to court without the victim. Still the punishment generally isn't enough and not enough protection for the victim after the fact.
Things are improving slowly. Now it's common if requested for the victim to be notified that the abuser is getting released. Usually a protection order is almost a given which may or may not do any good.
swilcher7
09-10-2014, 01:21 PM
Yes sir....I am well aware of the frequent fliers!!! Dealt with quite a few in my law enforcement and ems time. I totally agree, homicide is usually the end result of these issues. We even explained this to the victims, to no avail. I just watched on our local news here that a guy shot at his former girlfriends new boyfriend. He missed, then turned the gun on her, but didn't fire. He then was found in his apartment with self inflicted GSW, and still alive. That seems to be the norm anymore. If I can't have you then no one can...Myself, in some cases I believe if you're found guilty in certain crimes (murder, crimes against children, rape, etc) you should receive the same thing done to you as you did to your victims..But we know that will never happen...
swilcher7
09-10-2014, 01:30 PM
Protection orders aren't worth paper they are printed on. A majority of the time it's the plaintiff who violates the order by letting abuser back into their life. But, if they get into it again, said defendant on order goes to jail because of the order. Also there are times where protection orders have been used just to get back at someone. IE: someone leaves for another person, on going custody battle, etc.

Just saw that security at the hotel were interviewed. Report was, and you can see if you look closely at the video, is that Rice spit in his wife's face first, and she responded by what looks like an attempt to slap him. They get in the elevator and again he spits in her face while she is attempting to push button on panel. She then runs towards him and the knockout blow occurs. After he drags her out, you see a security officer come over, and Rice tells him she is drunk. She awakes, and says how could you do this to me, I'm the mother of your child. Then Rice makes a cell phone call and states "I'm getting arrested tonight." Also, the security officer watching the video is yelling over the radio to the other officer to "get him away from her." Rice is built like a tank, there is no excuse for this!! Again, this is what is being reported today. NFL owners now hired former FBI Director to conduct investigation in Goodell (yeah right). They need to do some major house cleaning. They have a few players now that were convicted of domestic violence. The team owners are saying, "we are waiting to see what happens in the appeals process." Well if you don't want to can them, suspend them until they have their appeal. This is the problem. Different types of punishments for different players. And all this occurred under Goodell's watch.

Analysis shows that cities funding the stadiums with public taxes and funds do not receive the economic benefits as promised by the NFL and city leaders. However, the NFL makes out like bandits.
