Officer Threatened: “I’m Going to Shoot Him in the *****,” Just Before Killing Homeless Man

Albuquerque police helmet cam video footage released by APD reveals a conversation between Officer Keith Sandy and a second officer shortly before the fatal shots were fired. In the conversation, Sandy says of Boyd, “For this f*cking lunatic? I’m going to shoot him in the ***** with a shotgun here in a second.” Just two hours later, Boyd was dead, shot by Officer Sandy.
Boyd, who had a long history of mental illness, was camping in the Sandia Foothills in the outskirts of the city. According to the City of Albuquerque website, “Camping is not permitted in Open Space without a permit.” Boyd did not have a permit, and argued with the officers. Reinforcements were called, and a three-hour standoff ensued. Eventually Boyd agreed to leave and walked away. When officers indicated he would not be allowed to leave, he took out a knife, although there is no indication he attempted to use it. Officers lobbed a flash-bang grenade and opened fire, killing him.

Civil rights attorney Shannon Kennedy says Sandy’s statement shows a premeditated decision to violently attack James Boyd. “Two hours later he’s escalating the situation so he can do just that,” Kennedy told KOB4. “It’s chilling evidence and stunning that he has not been criminally indicted… It’s crystal clear and he says it with contempt in his voice.”
KOB4 reports that Internal Affairs investigators questioned Sandy about his comment. Sandy initially characterized the comment as “locker room banter,” then later claimed the comment was never made. He argued that officers frequently make crude jests, to the point that a group of officers created a “safe word” to signal when the joking has gone too far.
“Of course it’s not a joke, because he went forward and actually shot him,” Kennedy retorted. “Clearly he has complete disregard for people suffering from mental disabilities.”
“What is so mortifying about this shooting, and thank goodness we have a tape to show exactly what he did – which is instead of shooting him in the *****, he shoots him in the lower back. So had James Boyd not turned around at that moment to set down his bags, he would have been shot in the *****.”
Sandy is now on administrative leave, but according to an APD spokesperson, he continues to carry his badge and gun. The city is being sued over the case, which has sparked widespread debate on the use of force by police.
