View Full Version : Delayed for pistol purchase

Hello all. I recently found a prestine condition smith 686-4. CAme with original grips and box. Yesterday i filled out the usual paper work. Problem is, I stupidly got in a bit of trouble and was convicted of two misdemeanor counts of failure to transfer firearms. I Had a good lawyer but got 3 months of house arrest.

My lawyer made it so i didnt lose any of my gun rights. So i am allowed to keep my firearms and shouldnt have any trouble buying any. So like i said, i filled out the paper work (i am allowed 4 hours per week to go shopping ect) and even told the officer at jail alternatives that i was going to be picking up a firearm that day. This is the first time i have been delayed. Is anyone knowledgeable on this subject? Do you think they will proceed me, or do you think they will deny? This is the first timei have been in trouble for anything legally. Sorry for the rant but i am curious. Thanks guys

Is the charge still pending in anyway, or is there a condition if you fail to abide by the house arrest condition.

If the charges are indeed misdemeanors then there shouldn't be an issue and they should proceed. Most likely this charge raised a flag and they are just researching further. Doing their due diligence.

In Washington at least in my dept we're now required to wait for a response on the mental health check which sometimes takes longer and would require a delay. It could be that in which case you got no issued, just a longer wait. All the shops used to love me because I would get approvals back to them in hours rather than days. I never ever received a decline from the mental health check. Now it usually takes several days to a week to get that response.

How did you manage to get caught not transferring a firearm.

no charges pending, everything is already done with but im only a week into my house arrest. Hoping it will only take another day or two to sort out because i am well known as a gun buyer and have always gotten a proceed right away.

I sold a buddy two pistols and later on he ended up getting a warrant and when they pulled him over they found the pistols. In the glove box was a bill of sale that we just wrote on a piece of paper. So they knew i had sold him the guns without going through an ffl. Lesson learned....

i will call the ffl tomorrow and see whats up. Im really anxious to get this snubby pre lock 686! Hope i they dont take too long.

So you are a "well known GUN BUYER", I am confused, is this a way of being a dealer without having a FFL? Do you just buy guns with the intention of re-selling and making a profit?
It sounds like you should get a FFL.

It means just like i wrote it... i buy guns from local gun stores all the time. Most of them know me beacuse i buy guns from them often. Not sure why you are implying i buy guns only to sell them on the street...
Now if i said i was A WELL KNOWN GUN SELLER, then your smug comment might actually make sense. Maybe pull the stick out your a$$ buddy? Thanks.

I didn't read the comment as smug. Reading it one way it makes perfect sense, reading it another I'm a well know gun buyer too, a frequent flier as it were. Lately I'm a frequent hanger arounder but don't buy so much.

You should be ok, sounds like you got a dedicated person who wants to make sure all it well. Government works in strange ways sometimes and many government employees should be working at Walmart, actually a I know a few who do now.

sorry i probably replied a bit harsh... But to me saying im a known gun buyer meens just that... gun stores that i buy from know me because i buy a lot of guns. Nowhere did i say that i SELL a lot of guns which i dont. The two that I stupidly did sell to a friend i got in trouble for, and am paying my debt to society. Not much else i can do other then that.

Hey now, don't make me come up there. We retired federal workers need something to do in our spare time (which is usually all day). I just recently retired from my position at the gun club and was thinking about Walmart. I can sit at the entrance and say "Welcome to Walmart" a few hours a day...It's just the smil'in part that prevents me from applying.

FYI, Walmart is doing away with the "Greeter" jobs.

Around these parts, you can get a job right now sitting on a corner wearing a Statue of Liberty costume, advertising Liberty Tax service. Just have to wave a sign, no smiles required.

I've been looking forward to being a Walmart Greeter. They did away with them then brought them back, now I understand they are changing the duties but are trying to find something else for the old, handicapped people to do.
They want them to do some clean up, be able to lift 30 lbs or something.

I can do that.

As much time as we spend at Walmart here at the department, they should have the greeters be security which I think they originally did, they'd check receipts kind of like Costco and stuff.

They'll probably snatch it away from me. I think I'd be a good door greeter. I've been practicing for years.

"Welcome to Walmart, get your stuff and get out" I changed a word or two for the family forum.

A note on the back of a napkin from AOC's bartending gig is good enough here in Florida for selling a gun. Reading this is just another reason I think leaving Washington state in 1992 was a good idea. Unfortunately, Florida is getting a deeper and deeper shade of blue each election.

Yup Washington is swirling the drain. East the mountains in the land of Alfonse they are talking about splitting the state in two. Far right over there, broken left elbow left on my side. Too many California transplants.
Oregon is suffering from the same affliction.

So much higher population density on the west, east don't have any say hardly at all. If they do split, guess they have tried it since about 1905, I'll be relocating asap.

An appropriate name for sure. Maybe it would be more appealing to them if we built the wall all around California, after we send back all the transplants of course.

Old Lincoln and a few others would of course be exempt but all heavily screened.

So is it 3 days they have to cone back with an answer? I think i read that but could very well be wrong. I went in Saturday and filled out paper work when i got delayed. So if its 3 days then by tomorrow i ahould get an answer if the 3 day thing is factual...

You don't have a CPL? Or were you delayed at time of purchase.

If there's questions they can put a hold and take longer than the 10 days to investigate.

Based on what you've shared you should still be ok. No felony, no DV, should get cleared to go.

so they told me today that the feds are the ones with the 3 day wait. He said Washington tacks on another ten days. So i guess this could take up to 2 weeks for the delay. Bummer...

Yeah, they want to call the new state "Liberty." We could use a little of that around here these days. Sorry to hear about the hassles. It sounds like it may get worse before it gets better.

i do have a cpl. I was delayed the day i filled out paper work. The guy told me today he would be surprised if it took later then the end of this week so i guess we will see. Patience has never been a virtue of mine lol

If that's the case it could be blessed any day or it could be delayed indefinitely. Some how there was a flag raised when the dealer called NICS.
Sometimes they get bad information and the local jurisdiction has to clear it up.

Patience has never been my strong suit neither especially when it comes to waiting for guns that I already paid for.

Hopefully they will clear it up quickly.

Well still no answer... called today and they said they havent heard back from NICS. They said of they dont hear back by the 18th i can come pick it up. I really hope my lawyer and the prosecutor held there word when they said I wouldn’t lose my rights. You would think if i did, they may have confiscated my currents firearms and my permit to carry... who knows. Maybe they are jist busy or having a hard time looking into my charge. I am still hopeful.

You haven't lost your rights near as I can tell. They would have advised you of that and given notice to get rid of the guns you got. Even then you could get your rights restored. It's not easy and takes time and a lawyer=MONEY but there are lawyers=Money who do nothing but that.

The shop saying you can come get it after a certain date sounds like a purchase without a CPL. We have 10 days to respond and then the shop can call and get their own approval. But since you have a CPL that should have happened on day of purchase so there's no time limit. I'm terribly confused.

Wish I could do some checking for you but we get in a lot of trouble if we're digging for something other than we're supposed to be digging into.

I read in the state of WA they tack on 10 buisness days to release the firearm if the dont hear back from NICS. I dont think many other states do this but thats what i heard. Thank you for your advise Bawanna. You have always struck me as a stand up guy. In the mean time, heres some eye candy for you. The 686-4 i am HOPEFULLY going to havein my possession in the near future!

Omg im sorry i had no idea! That is pretty funny though. I think if you saw the price tag on the Smith you would think twice. Im embarrassed to wven say how much im paying for the thing...

Don't be sorry a bit, thought it was hilarious. I know too that they don't give those 686's (any dash) away. Hence the reason I don't have one or a Colt Python or a myriad of others I dream about from time to time.
Figure one of these days, lord knows we've tried I'll get together with Alfonse and maybe hold his. Might happen someday, come close couple years back.
