View Full Version : no gun on apartment lease?

Well guys i recently moved to nice apartments in antioch tennessee out of the ghetto ones i was in. In the lease it states a no gun policy. I would like to order a recoil spring for my pm9 since its near 1500rds and a crossbreed holster. My mailbox is a dinky little box and they told me if ups couldnt make it fit (which i think it would fit) ... they would hold the mail for me. Now if they did hold the package and see kahr arms or crossbreed holsters on the package; is that enough evidence to kick me out of the apartments or am i over thinking this?
Anyone else live in apt with this policy?
Or should i just have a gun shop order the parts and holster and pay a little more money and be safe?

It's perfectly legal for YOU to sign away your own rights. Which is what it sounds like he did if he signed the lease and did not modify that part of the lease before signing it.

I would have found another place to live, screw them and their lease rules. NOt sure they can come into your apartment either to search etc or how in the hell they would even enforce it , but there has to be other palces to live that don't even mention that kind of crapola.
wow they ought to post on the entrace to the aparment complex. THIS AREA IS TOTALLY FREE OF GUNS, THIEVES HAVE AT IT!!!!!!!!

kahr doesnt ship to po boxes....but ill just have a shop order it. Hey um all against gun free zones...but this was the best place to live around this area for the price. Its not like im going to open carry so ill still do as i please and carry and just order gun parts and accessories at a local shop.

You could become the test case for that, but why. The PO is a good idea, and the move is better when the lease runs out. Me, I wouldn't flaunt my guns, but they could kiss my hairy white butt if they think I'm going to be defenseless.

If I lived in Tennessee, I would be checking the state laws concerning the issue. I would suspect that in some states one could be convicted of criminal tresspass (or similar charge) if caught knowingly in possession of a firearm on property where sufficient notice was given that firearms are not allowed.

I can't see how an apartment complex rule can supercede state or federal law. I certainly wouldn't worry about it, but as you said I wouldn't flaunt it either. Maybe you could have the package shipped to a friends home and avoid any issue.

Also, the OP said Kahr wouldn't ship to a PO Box... There are places like Mail Boxes, Etc. that "work" like PO Boxes, but they give you a physical street address with your name on it. Anyone shipping to that address would have no way of knowing what type of address it is.
There are easy ways around this "shipping problem", but it sounds like the OP might just be too cheap to pay for a PO Box or similar type service.

After thinking about f44life's post think about this, in my early days most folks were young, very young in my apartment complex. The good side of this is there will be a minimum number of kids handling guns with the possibility of an AD and the bullet going through three or four walls before stopping. F44life still has his protection, and is in less danger from untrained kids.
I would still keep and carry in spite of the lease, what is the worst that can happen? Maybe have to move!

If it were me, I would continue to live there if I liked the apartments, keep the gun, and arrange for an alternate delivery address. They have every right to prohibit guns since it's their property, and they put it in the lease, but I think the worst that would happen if they found out, would be to ask you to move.

The area where he lives is not the place where I grew up anymore. It's also not as safe any more either which is why you need protection. I stayed at my grandmothers house growing up very near there and now it's not as safe as it used to be. Too many feel good liberals have moved to the Nashville area and have changed things since I left 30 years ago. I think they even elected a mayor from New York or somewhere like that. They all probably showed up when Al Gore was VP.
Oh well. enough of that from me.

What O'Dell said! You like the place so stay, just get your parts from a shop and keep the rest to yourself (like you should anyway). That really means don't tell anybody as they may get drunk or pissed or whatever and say something without meaning to.

I know that area well. Grandmother lived in the square between Thompson Lane, Nolensville Rd., McCall St., and I-24. That area is not the same place it was before. You need that PM9. But if it's anywhere close to work that's where to be. Traffic there is crazy now too.

Personally, after reading such BS in the lease I would have ripped it up before signing and told them why. Since you have already signed the lease, concealed is concealed. I'm just sayin'.

There is no way I would have agreed to giving up my 2A rights for some apartment. Depending on the penalty (misdemeanor or felony) in TN a criminal trespass for CCW on that property could end up costing you your rights.

i suspect that you are over thinking the whole situation. Kahr sells other items besides firearms. Your landlord/property management company have no idea what is in the package and they don't have any right to know what you ordered. For all they know, you ordered a baseball cap for your cousin as a present for his birthday. They may own the property, but your personal belongings are yours and even though you are leasing living space on their property, you didn't sign away your rights to your privacy surrounding your personal items. They are not entitled to search your personal property. I believe that would require a search warrant and probable cause to justify a warrant. They may be allowed to enter your apartment while you are not home, but they can't rifle through your stuff and even if they did, I would expect the firearm would be with you if you have a CCW and not left alone in your apartment. That said, keep it concealed and what ever mail that you receive is your business. I would just order the spring and holster and have it shipped to where you live. If they ask you what's in the Kahr box, I would say, "none of your business, but if you must know it's a holster for my cousin's birthday present." I doubt they will ever have the stones to even ask you.

Just an FYI in case it should go badly at some point. A local I know moved into an apartment after signing such a lease. He later had an accidental discharge, so there was no hiding he had a gun. He was evicted within 24 hours, his deposit kept, and his credit score tagged for the eviction. Yes, they can put that on your credit as a default. Obviously I completely disagree with such lease terms. I just want to make sure you know all the risks to you as I would hate to see that happen. Personally I would advise moving at your earliest convenience.

Lesson learned: don't be an idiot and have a NEGLIGENT discharge in your own home. :rolleyes:
