When I first saw and held a diamondback, I felt that it was very similar to the p380...I didn't like the fact that the slide doesnt lock back after the last round though. I wouldn't trade my P380 for one! I love it! It's my daily companion whenever the PM40 won't do.

Well this is not unheard of. Years ago Glock sued (successfully) Smith and Wesson and their Sigma Series. That suit showed a slide from the Smith and Glock as being almost interchangeable. I think it was more of a polymer frame issue than a mechanics issue though personally.

Unless I missed something....what patent infringement are they suing about?

Sounded like the trigger assembly mostly.

That's what I wanted to know too, but I can't find it.

Seven U.S. patents cover Kahr’s unique locking, firing and extraction systems. The incomparable cocking cam trigger system employs a patented cam to both unlock the passive safety and complete cocking and releasing of the firing pin. The system provides a “safe cam action” and unbelievably smooth double action only trigger stroke, fast to fire in critical defensive situations.
These innovations found only in the Kahr pistol give the Kahr shooter an advantage in self-defense, home protection and duty or off duty use. The Kahr design is original, creating the smallest package possible in four defensive calibers – 9mm, .40S&W, .45 ACP and the .380 ACP.
All in the fire control system near as I can tell.
The Diamondback feels and looks SO CHEAP. Hubby considered one, but they just looked so poorly made he didn't think it was even worth the $299 or whatever it was they were asking for it. ("black friday" sale price at Academy Sports). The finish was already wearing off of the display model.

they arejust down the street from the kel tek copany and I hard alot of kt empolyees went there. For their price what do u expect?? More than likly will go bang when needed but not a "pride" gun..
Not far from J.A.Ceiner either....
Dunno about the lawsuit. I looked at the Diamondback 380 sear... very similar in working and arrangement to Kahr.

that worthless ceiner company has to be the most arogant sob's egver to wak. I ordered for my G19 their 22 k9it and it took 6 months to get it, they would not answer any phone calls and I must have called them 50 times, They would not anwer mail and I had to get mydaugherr who is an attorney in florida to put some pressume on them to finalyl get my 22 kit, which is certainly not a good 22 kit either IMO. It works.
terrible company to do business with, the pitts, don't get me started on those fokkers..
Agreed! And, they are the makers of other's "conversions" as well, with only the names changed.
OTOH - the Tac-Sol unit... what a joy, but I digress....

The Diamondback 380 has had a huge number of problems. At the Diamondback Forum almost everybody has had trouble with the shocking lack of design/quality from DB.
Now they are trying to introduce a 9mm pistol on a slightly larger frame than the 380 and they have not ironed out the 380's difficulties. If DB copied Kahrs design they deserve whatever befalls them.
I don't think it would be an exageration to say the Kahrs are as good or better than the DB are troublesome. Opposite ends of the quality spectrum.
The Diamondback's are half the price of the Kahr....does anyone really believe they'd be similar in quality?!?!?!

Diamondbacks have to be some of the ugliest pistols I have seen. Bleh....
I suspect they won't be around long if they did copy Kahr designs. ;)

Didn't Kahr sue Colt over Colt's pocket 9 ??
I think part of that suit was around the feed ramp....the way they line up??
It's been a long time and I may not remember correctly as I'm old and still drink.

All I can find on the Colt Pocket Nine lawsuit are a bunch of anecdotal stories from various gun forums, not an actual news report. From what I gathered, the Pocket Nine was only produce for one year (1999) when Kahr Arms sued for “patent infringement on Kahr's off-set barrel feed ramp design.”
It looks like to me that if any company enters into the slim handgun market, they'll need to have a Kahr nearby to know what not to do.

Or one can be like kel tek, and not patent any parts on the p380 andP32 and then ***** to high heaven when Ruger copied it and improved upon it.

I tried that too yesterday, although not for long. I couldn't any Kahr specific patents online. I'm sure they're out there somewhere though.

Attornies specializing in patent law want it complicated and difficult to locate patent applications and grants. That way they can charge hundreds of dollars an hour. Dang lawyers.

Thanks for the update. Hopefully they prevail against Diamondback if Diamondback really did copy Kahr's idea(s).

I would love to read the actual court papers. Unless they are under seal they are public records that anybody can see. Patent and trademark lawsuits can be very tricky. You can win on paper and then loose in the marketplace.
For example Kahr could prevail and the judge order DB to change their design and award no monetary damages. Seen it happen before.
