So I've heard conflicting things about private sales of a gun, from paying a gun store the 50 fee to just doing the background check myself and paying the 10 dollar fee. I've also heard all I need to do is get their drivers license to confirm identity and I'm fine. I wonder if anyone would buy my gun if I required the ssn to run the back ground check in the first place. Anyone do many private sales in oregon?

I'm not up on the specific rules in Oregon but I think it's very similar to Washington. You really don't need to do anything on a private face to face sale. You can't knowingly sell to some one who is not qualified to buy but your also not required to ask. Many private seller require a CPL and a D/L but that's for their personal comfort.
No one requires a SSN to run a background check, a Driver License or CPL would suffice.
For you own benefit I would write up a bill of sale with the buyers current address and the DL number etc, just in case he ever uses it and the police come knocking on your door you have proof the date that you no longer had possession.
I don't believe a private party can even do a background check, that has to go thru a dealer. You can fill out a transfer form and send it in I believe and they do the check.

I typed a gun B of S with I use whenever I sell a hand gun. I think I'm protected with this as the buyer signs a statement that it is legal for him to purchase the gun.

I going to try to attach a copy. It may or may not work, but if not, PM me and I'll E-Mail you a copy.

Thanks, I downloaded it and changed to my name, just placed the ad in oregonlive and hope some one wants a fine gun.

In CA you have to do the FTF at a licensed dealer and the buyer has the same restrictions as in buying a new gun from them, including the 10 day wait. The dealer does also including the safety instructions and a ton of paperwork. Their fee is fixed by the state and it is not enough for the stuff they have to do.

Needless to say, if it's a gun just like the one they have in the case their jaws get a bit locked up and one told me he'll turn them away saying he can't get to it for a few days.

Luckily I was selling my Colt Mustang which hasn't be made since the 90's and the store owner knows me from holding my hand a bit and making sure this gun worked okay after all those years not shooting it.

The buyer must get a Permit to Purchase unless he can show a CPL, then a different form is used at the point of sale. More details and the sample forms in the link. You may only sell to a fellow resident of Michigan unless a FFL is used.

Thanks for this O'Dell. We're still fairly unrestricted in AR. Just need to confirm age of 18+ and that the buyer is an AR resident. It would be nice to have your form as a back up.

Well, after over thinking the issue, and shooting my new CM9 better than my PM9, I decided to sell the PM9 and use the money on a Glock 23 for use when hiking and camping. I'm torn, but, as I said in another thread, I got the bug.

Absolutely nothing wrong with that. I hate to sell guns and just find myself adding too which probably isn't the smartest thing to do but since they are my favorite thing it works for me.

You could certainly list it here for the gang. No big trick to shipping it to another state either. Has to go thru FFL's but thats easy.

I have a freind in Oregon even, I might mention it to him to see if he's interested. He shot my PM45 last year when we met up in eastern WA and liked it alot. I can't remember exactly where he's at, if it Portland or Lake Oswego?? Not sure I even got the name right on that. Oh well.

In Oregon, State law does not require anything special for private sales between individuals. It is in your best interest to have reasonable belief that the individual buying the gun is not a felon or other person whom the law might prohibit from owning a handgun.

You may elect to ask for an ODL and to provide a bill of sale signed by both buyer and seller. You may also, at your discretion, do a background check with the OSP. Anyone can utilize this service, but it costs $10. Contact the OSP in Salem for the details on how it works.

It all depends on your tolerance for risk.

In Ohio, FTF doesn't require any kind of check. I usually ask for an Ohio ID where I copy down the info and license number. I make up a bill of sale, have them sign it and thumbprint it. I give them a copy and I keep the thumbprinted copy. Once someone balked at giving me a thumbprint, but I said, I have your prints all over the paper anyway when you signed the bill of sale, it's just easier for me this way.

If they don't want it, then I take my gun and walk away.

Was it a Gen3 Glock 27 or Gen4 Glock 27? I already have a Glock 33 gen3 and am waiting for the gen4 Glock 32 to come out. They just came out with the 31, and have a 23 and 27 so the 32 and 33 should be along any minute.

I just ordered a CM9 the other day. :)
